Letter from landlord's agent notice to vacate premises

This is a statutorily defined document regarding tenant's rights.

Landlord's agents are required to give notice in accordance with the terms of the agency agreement, which relates to contract law.

As the agent for the landlord, you are required to comply with statutes.

As a third party to the tenancy, you are obliged to act in accordance with the landlord's wishes.

However- If the notice to vacate, or any matters arising from the notice are in breach of a tenant's rights or in violation of statutes, (like giving insufficient period of notice, or failure to notify of rights if required by law), you are obliged to inform the landlord of the statutory requirements.

You may be in breach of both statutes and your agency agreement if you fail to do so.

Any action contrary to tenancy laws may be actionable. The notice to vacate may be deemed invalid in any dispute under those circumstances.

Notice to quit premises at (insert full address)

Under instructions from the owner of the premises, you are hereby given notice that your tenancy of the above premises will cease as of ( insert date).

This notice is given in excess of the statutory period for notification required under (insert name of applicable law).

You are required to vacate the premises as of that date.

In accordance with the provisions of (insert name of law) you may, if necessary request an extension of time to vacate, or lodge dispute the notice to vacate in accordance with that law.

(Note: If an extension is required, please notify me as soon as possible.)

Strike out sentences which do not apply:

The keys and any spare keys to the premises are to be returned on that date.

No property or materials are to remain on the premises. No responsibility can be accepted for any property left on site.

Bond / deposit money

Note: Bond or deposit monies are covered by statute.

Your bond will be refunded upon application to (insert name of bond holding authority)

Your bond may be used as rental, if you prefer, with your written agreement, and will be payable to me on termination.

In view of the circumstances, repayment of your bond money will be disputed with (insert name of bond holding authority).
